Broad Geographic Experience

Our unique combination of US and European antitrust experience allows us to deliver significant benefits to our clients. Two examples of our ability to advise clients on matters with both US and European implications are:

  • Acting for BASF and Lonza in their individual defenses of actual and potential civil litigation claims by third parties in the USA and Europe in relation to the 'Vitamins Cartel.'

  • Acting for the Computer & Communications Industry Association in relation to various matters before both the EU Commission and the US Courts concerning the cases against Microsoft Corporation.

Our clients' transactional work is eased by our ability to deal seamlessly with the antitrust authorities in the US and Europe. We have the experience, increasingly essential for effective action, to assimilate the arguments and present common themes or issues, whilst our local presence and experience allows us to fine-tune the arguments to the relevant governmental authority. This approach is an important contribution to success given the ever closer and formal co-operation between the US and EU authorities.

Significant Litigation Experience

One measure of the excellence of our US litigation appeal practice is that our current lawyers have argued approximately 170 cases in the US Supreme Court. In Europe, we have the experience and resources necessary to effectively manage the multi-jurisdictional litigation particular to European courts.

This depth of experience, coupled with a collegial atmosphere that fosters communication and the sharing of ideas among our lawyers, delivers benefits to our clients on both sides of the Atlantic.

Detailed Transactional Experience

We have many years of experience in the project management of multi-jurisdictional filings. It is a consistent element of our work, and we have the ability to advise on applicability of national merger control regimes, throughout the world.

We also deal regularly with cases of substantive antitrust and competition law concerns. This work has contributed to our reputation as the law practice of choice for companies addressing "deep thought" issues. We have helped our clients with second phase investigations under local merger regimes, under the EC Merger Regulation and with litigation against the FTC before US Courts in pursuit of a merger.
