Experience
Simon is the head of the real estate litigation group within the litigation practice of the London office. He has advised on all aspects of real estate dispute resolution, with a focus on litigation relating to insolvency in a property context, but also including rent review, injunctions, alternative dispute resolution and property management.
Simon has substantial rent review experience working for landlords and tenants both in the City and West End markets and outside Central London. He also advises in relation to rights of light, nuisance, possession claims and emergency injunctions against trespassers. Simon advises on legal issues taken to arbitration, independent expert determination and adjudication, including disputes regarding overage payments and planning. Additionally, he advises in relation to all aspects of contentious real estate management work, including lease renewal, dilapidations, restrictive covenants and easements and environmental contamination.
Simon is a senior associate who, prior to joining Mayer Brown in 2008, worked for another large international law firm. Notable Engagements
- Barclays Bank v. Guy, acting for a mortgagee in relation to the successful removal of notices registered on the title of a development property by a previous owner, who was claiming the transfer from him was fraudulent, and appearing in the Court of Appeal, who refused the former owner leave to appeal.
- KPMG v. Network Rail, acting in relation to a dispute involving rectification and construction claims, heard in the Court of Appeal.
- RWE npower v. Lee Harwood and others, obtaining an out-of-hours injunction against protesters interrupting production at a power station.
- Acting for a landlord on the rent review arbitration of a substantial Grade A West End office, including factual evidence and expert witnesses in valuation, marketing, mechanical/electrical issues and space planning.
- Advising on disputes involving judicial review and professional negligence.
