Experience 

Devi focuses on all aspects of restructuring and insolvency and has a particular interest in international and cross-border insolvency and restructuring matters, as well as pensions aspects of restructurings.

Devi has extensive experience in insurance insolvency and restructuring matters, including advising on provisional liquidation, schemes of arrangement (including international recognition and enforcement issues), proof issues and set-off, including set-off across jurisdictions.  She also has experience in handling financial disputes, with  particular experience in acting on guarantee claims and on restitution issues, as well as advising on fraud and other breach of duty allegations against professional trustees.

Devi has been recognised as a rising star in the insurance insolvency area, "she's warm, friendly and knows her stuff." (Chambers & Partners UK Directory 2009 ), a "safe pair of hands" notes Legal 500, 2009, "dedicated and capable" remarks Legal 500, 2008.

Notable Engagements 

  • Acting for a number of major banks in relation to their exposure to companies in the Lehman Group.
  • Acting for the trustees of the Woolworths pension scheme in connection with the collapse of that group.
  • Advising the liquidators of the Guernsey hedge fund Carlyle Capital Corporation Limited.
  • Assisting Mayer Brown's pensions practice in advising the Trustees of the Northern Rock pension scheme on the implications of the range of alternatives for the future of the bank.
  • Advised the Administrators of the reinsurance broker Park London Limited (partners in KPMG) on all aspects of the administration.
  • Advising an Australian liquidator on a potential s426 application.
  • Advising on restructuring of RMBS vehicle.
  • Advised on various proposed restructurings involving companies with pension deficit liabilities including through deploying a company voluntary arrangements.
  • Acting for a leading UK reinsurer (part of a large multinational group) on two proposed solvent schemes of arrangement, one involving a pool of reinsurers, including in relation to a proposed US Chapter 15 recognition application.
  • Advised Fleet National Bank as security agent in relation to the proposed restructurings of a multi-national group, including in relation to enforcement of Chapter 11 stay and discharge of debts in the UK, and coordinating European insolvency and restructuring advice.
  • In conjunction with our colleagues in Mayer Brown's pensions practice, advised the Trustees of the P&O pension scheme on a high-profile, ground-breaking buy-in deal with Paternoster.
  • Advised the joint liquidators of Manning Williams Limited (a Lloyd's broker) on all aspects including on status of IBA accounts.
  • Acted for a German landlord in relation to the administration in England of a German based tenant, including advice in relation to the EC Regulation on Insolvency Proceedings and the interaction between proprietary rights under German law and the English administration moratorium.
  • Advised on the structuring of a contingent asset including on complex enforcement issues for pension trustees.
  • Acted for AFG Insurances Limited and its Administrators (Ernst & Young) in relation to proceedings concerning reinsurance and set-off issues arising in the context of the insolvency of members of an insurance pool (NAIC -v- Nationwide & Others) and in relation to its position as creditor of North Atlantic Insurance Company Limited, including as regards the latter's scheme of arrangement.
  • Advised on the restructuring of Interoute Telecommunications Group.
  • Acted for the liquidators of a company which operated a pyramid selling scheme, including advice on actions against directors, antecedent transactions and asset recovery.
  • Advised on duties and potential liability issues arising in the context of an African Gold mine restructuring.
  • Advised a global cargo group in relation to the collapse of Swissair group, encompassing cross-border insolvency, jurisdiction and set-off issues.
  • Acted as part of a team for Bank of America in proceedings brought against it by the liquidators of BCCI.
