Matthew Ingber is a business litigator who knows how to try – and win – big and important cases for clients. He represents financial institutions, major corporations, technology companies, and individuals in complex, sensitive, and high-profile litigation matters that are often mission critical and help protect their valuable assets, including brand and reputation. He conducts a general litigation practice before state and federal courts, with cases ranging from complex commercial disputes to civil and criminal securities fraud actions, environmental claims, and cutting-edge intellectual property matters. Matthew performs internal corporate investigations on behalf of various boards and special committees and represents, often as lead trial counsel:

  • Global financial institutions, including lenders, administrative agents, and securitization trustees
  • Technology companies in high stakes copyright infringement actions
  • Issuers and underwriters in federal securities class actions
  • Major global businesses in environmental liability claims

Erfahrung

  • Secured a total win in the multiyear defense of Spotify USA Inc. against music publishers Eight Mile Style and Martin Affiliated in federal district court in Nashville, Tennessee. Judge Aleta Trauger held that plaintiffs, the publishers of 242 of many of Eminem's most iconic musical compositions, were equitably estopped from asserting copyright infringement claims against Spotify since the claims were “tainted by the plaintiff's knowing, culpable role." This foreclosed plaintiffs' pursuit of more than $100 million in damages from Spotify and co-defendant Harry Fox Agency and blocked plaintiffs’ efforts to undo as unconstitutional key elements of the Music Modernization Act.  Spotify also prevailed on its third-party indemnification claim against Kobalt Music Publishing America, Inc.
  • Represented Citibank in two-week bench trial and related appeal arising out of $1 billion mistaken wire transfer, resulting in return of all mistakenly-transferred funds. In re Citibank August 11, 2020 Wire Transfers, S.D.N.Y. 2020.
  • Representing Veolia in federal and state environmental tort actions arising out of its operation of a wastewater treatment facility.
