In recent years, trade secrets have been increasingly being used to protect intellectual property. At the same time that patent cases have been falling, trade secret cases are seeing a surge. This uptick has been fueled by, among other things, the rise of artificial intelligence (AI) coupled with the concern of patents and copyrights to provide suitable protection, and large damages awards. Join us for a dynamic session designed to provide an overview on recent trends in trade secret litigation. The session will cover the evolving use of trade secrets as a vehicle to protect AI, the available damages remedies for trade secret misappropriation, the use of International Trade Commission as a forum to litigate trade secret disputes, and practice tips for enforcing trade secrets.
