Overview

Gabrielle Levin offers corporate clients extensive experience in employment and complex commercial litigation matters. Her experience spans nearly two decades.

Gabrielle defends employers in Sarbanes-Oxley and other whistleblower protection litigation, discrimination and retaliation claims, executive compensation disputes, restrictive covenant and trade secret litigation, and wage and hour class actions. She has first-chaired jury trials in federal court and led the defense of employers in arbitrations. Gabrielle also has significant experience representing public companies in class actions.

Gabrielle is also active in the community. She currently serves on the board of directors of The HOPE Program, a non-profit focused on empowering New Yorkers to overcome poverty though skills training, jobs, and career advancement.

Experience

  • Won unanimous jury verdict in age discrimination case brought by senior sales executive of medical device company.
  • Obtained dismissal of disability discrimination claim brought against private equity firm.
  • Led trial team at district court level and overturned whistleblower retaliation verdict on appeal for UBS (Trevor Murray v. UBS Securities (S.D.N.Y. and 2d Cir.)).
  • Won unanimous jury verdict for HSBC in retaliation case brought by senior executive under Title VII, the New York State Human Rights Law, and the New York City Human Rights Law (Picarella v. HSBC (S.D.N.Y.)).
  • Won summary judgment for UBS in whistleblower retaliation suit brought by former financial advisor, which was affirmed on appeal (Price v. UBS Financial Services (D.N.J. and 3d Cir.)).
  • Won summary judgment for former CEO of publicly-traded company in Sarbanes-Oxley whistleblower retaliation case (Zornoza v. Terraform Global (S.D.N.Y.)).
  • Defeated compensation claim brought by former executive of large financial institution after a 5-day arbitration (FINRA).
  • Obtained victory for large financial institution after 10-day arbitration proceeding with former employee who asserted claims for breach of contract, Dodd-Frank whistleblowing, and defamation (JAMS).
  • Won motion to dismiss drug testing class action, in first of its kind decision interpreting New York City’s marijuana testing statute (Thomas v. Amazon (E.D.N.Y.)).
  • Won motion to dismiss racial discrimination class action (Smalls v. Amazon (S.D.N.Y.)).
  • Defeated attempts by large public company to obtain preliminary injunction prohibiting former employees from working for competitor based on alleged theft of trade secrets and alleged violations of restrictive covenants.
  • On behalf of audit committee of publicly-traded company, conducted internal investigation of employee complaints of gender discrimination and hostile work environment.
