French listed and unlisted companies, as well as investment and debt funds rely on Marc Santoni to advise them in the management of their difficulties or in their planned acquisition of distressed companies.
Marc Santoni participates in the diagnosing of difficulties and the search for solutions, either through preventive measures in bonis, the use of ad’hoc mandates or mediation and, where appropriate, under the aegis of the CIRI. He assists companies in the opening of safeguard, receivership or insolvency proceedings, in order to draw up safeguard or continuation plans. He also advises debt funds and corporate creditors on debt restructuring, particularly in the case of LBOs or PGEs requiring restructuring.
Experience
- realized the first taking of control by a bank creditor of an LBO.*
- was involved in the realization of the first “pre pack“ which led to create a legislation applicable to that nature of operation.*
- was involved in the implementation of the first prepack pursuant to the new French legislation.*
- opened and treated the first Accelerated Financial Procedure (SFA).*
- proceeded to the first « fiducie » (French trust) on a waterfall of securities in favor of the creditors in the framework of a restructuring.*
- proceeded to the first PGE for a New-co to take over of the assets of a bankruptcy company.*
