NY Financial Services Roundtable: Recent Cyber Developments and Mitigating Legal Risks
Cyber threats to the financial services industry continue to increase. At the same time, regulatory requirements, litigation risk, contractual requirements and regulator expectations continue to grow. Please join us for a half-day Cybersecurity Awareness Month program that will highlight key recent cyber legal developments and tools that financial services companies can use to mitigate associated legal risks.
This program—led by Adam Hickey, former Deputy Assistant Attorney General, who supervised high-profile cyber investigations for more than a decade, and Justin Herring, former Executive Deputy Superintendent of New York’s Department of Financial Services (NYDFS), who supervised the development of its cyber regulation—will feature current law enforcement and regulators, including:
- Arsen Ablaev – Senior Attorney, Cyber Unit, US Securities and Exchange Commission
- Danny Brando – Cybersecurity Policy Program Director, New York Federal Reserve Bank
- Amit Kachhia-Patel – Assistant Special Agent in Charge, Cyber Branch, New York Field Office, FBI
- Sagar Ravi – Chief, Complex Frauds & Cybercrime Unit, U.S. Attorney’s Office for the Southern District of New York
and private sector leaders, including:
- Matt Gorham – Cyber & Privacy Innovation Institute Leader, PwC; Former Assistant Director, FBI Cyber Division
- Nikki Nielson – Cyber and Privacy Counsel, SMBC
- Daniel Shapiro – Vice President & Associate General Counsel for Cybersecurity, MetLife
Trends in the Evolving Threat Landscape
In the first half of the program, our panelists—including current and former FBI cybersecurity experts—will discuss how financial services companies can manage growing legal risks associated with complex and diverse cyber threats. Topics will include:
- How the evolving threat landscape implicates software security and third-party risk
- Changes in Washington’s operational approach to cyber threats and what that means for companies
- Best practices, in light of regulatory oversight, when working with law enforcement
The Regulatory Landscape: What Financial Services Companies Need to Know
The regulatory landscape for cybersecurity is rapidly expanding. NYDFS has proposed significantly expanding its cybersecurity requirements for banks, insurance companies, mortgage originators and servicers, and other non-bank financial services companies; final rules are expected to be issued this fall. The US Securities and Exchange Commission (SEC) just finalized new disclosure and incident reporting requirements for public companies. And more cybersecurity-related rules are pending with the SEC and both state and federal financial services regulators.
In this session, those on the front lines will help you understand:
- Common themes across these new mandates, such as expanded governance, reporting, and disclosure requirements
- The likely impact on financial services companies and their compliance and cybersecurity programs
- How financial services companies can prepare for regulatory examinations and reconcile and manage cybersecurity requirements from different regulators
- Practical effects of the expanded notification obligations and shorter timeframes
