China's Pharmaceutical Patent Linkage System

Through the fourth amendment to the Patent Law of China in 2020, China established its own pharmaceutical patent linkage system. In December 2021, the Beijing Intellectual Property Court accepted the first pharmaceutical patent linkage lawsuit and issued its decision on April 15, 2022. This presentation will discuss China’s new pharmaceutical patent linkage system, including the legislative process and its current operation in practice. Topics will cover: 

1. China's legislative progress on the pharmaceutical patent linkage system;
2. China’s compensation system for the protection period of Chinese pharmaceutical patents;
3. A brief introduction to the early resolution mechanism of pharmaceutical patent disputes in China;
4. An introduction to the current operation of China's patent linkage system
