Mayer Brown obtains Ninth Circuit victory for voter rights in Arizona
Mayer Brown successfully counseled Living United for Change in Arizona (LUCHA), League of United Latin American Citizens (LULAC), Arizona Students’ Association (ASA), Arizona Democracy Resource Center (ADRC), Arizona Coalition for Change (ACC), the Inter Tribal Council of Arizona (ITCA) and the San Carlos Apache Tribe in challenging two restrictive Arizona voter registration laws, H.B. 2492 and H.B. 2243. These laws were found to violate the National Voter Registration Act (NVRA), the Civil Rights Act, the Equal Protection Clause, and a 2018 consent decree between the Arizona Secretary of State, LULAC, and the ASA.
The United States Court of Appeals for the Ninth Circuit upheld the district court's ruling that several provisions of the laws, which required documentary proof of citizenship and imposed other stringent voter registration requirements, were preempted by the NVRA and violated federal protections. Additionally, the court vacated the district court's finding that H.B. 2243 was not enacted with intent to discriminate and remanded the issue for further proceedings.
