Construction team partner Tom Fu and counsel Rosalyn Han delivered a webinar on PRC Civil Code and the latest developments of Chinese construction law to more than 400 members of Hong Kong Institute of Surveyors on 12 March.
The webinar focused on the newly enacted Civil Code of the People’s Republic of China (Civil Code) and accompanying Judicial Interpretations which came into effect on 1 Jan 2021. The team highlighted the major changes in the legislation and potential pitfalls including changes to termination provisions, force majeure events contrasted with the Chinese doctrine of major change in circumstances, time bar provisions. Force Majeure involved discussion of the current COVID-19 pandemic. Other major changes relating to workers protection, the reform of the qualification management system of construction enterprises and the new Chinese EPC contract template were also discussed.
