Mayer Brown appellate team secures $90 million judgment for Rostack
Capping a 14-year-long battle, Mayer Brown prevailed in an appeal of a $90 million judgment in favor of Rostack Investments in California state court.
The case, Rostack Investments Inc. v. Angela C. Sabella, involved a $30 million loan that Rostack made to its deceased founder’s daughter, Angela Sabella. After Mayer Brown prevailed at trial in 2021—securing a $69 million judgment for Rostack and a $21 million fee award—Sabella appealed the judgment, arguing that the trial court improperly refused to allow a portion of Sabella’s case to go to a jury, and that the judge’s fee award in Rostack’s favor was improper.
On November 13, 2023, the Court of Appeals of California rejected Sabella’s appeal of these issues and affirmed the trial court’s judgment in its entirety.
The appellate team included partners Nicole Saharsky, John Nadolenco, Matthew Marmolejo, Daniel Queen and Jennifer Chang and associate Carmen Longoria-Green.
