The overlapping powers of Anvisa and consumer protection agencies in Brazil
Our partner Flávio Amaral (Public Law), along with counsels Felipe Derbli (Public Law) and Rodrigo Zambão (Public Law), have written an article on the overlapping powers of the Brazilian Health Regulatory Agency (ANVISA) and consumer protection agencies in Brazil for issue no. 79 of the Public Law Journal of Economics (RDPE), coordinated by Professor Egon Bockmann Moreira.
The article analyzes the need for compliance with regards to sanctioning standards in sanitary surveillance, reflecting on the instability and legal uncertainty created by the overlapping responsibilities between the Brazilian National Consumer Office (Senacon) and Anvisa. The authors suggest criteria and parameters to increase legal certainty, predictability, reliability and consistency in the exercise of the powers of these regulatory agencies and entities.
