WTO争端解决

我们的律师对WTO争端解决程序拥有丰富的经验。这些经验涉及WTO所涵盖的国际承诺与义务的方方面面，包括《补贴与反补贴措施协议》、《技术性贸易壁垒协议》、《卫生与植物卫生标准协议》、《农业协议》、《海关估价协议》、《保障措施协议》、及《反倾销协议》。我们始终参与在日内瓦进行的WTO争端解决程序。本行律师参与的代表性WTO争端案例包括：

• 巴西－对阿根廷聚对苯二甲酸乙二醇酯树脂采取最终的反倾销措施案（DS355）。达成对本行客户有利的和解方案。
• 欧洲共同体－影响商船贸易措施案（DS301）。全面胜利。
• 危地马拉－对从墨西哥进口的硅酸盐水泥进行反倾销调查案（DS60）。所有问题均赢得上诉。
• 韩国－影响商船贸易措施案（DS273）。全面胜利。
• 墨西哥－对牛肉和大米采取最终的反倾销措施案（DS295）。在所有重要问题上均赢得胜利。
• 美国－对韩国DRAMs征收反倾销税案（DS99）。在所有重要问题上均赢得胜利。
• 美国－对加拿大软木木材征收反补贴税的初步裁定案（DS236）。在专家组阶段赢得六项问题中的两项；无上诉。

市场准入及战略咨询
WTO执行的以规则为基础的贸易系统减少了，且在许多情况下消除了长期存在的贸易壁垒。货物贸易、服务贸易及知识产权贸易已迅速扩张为关税配额，其他传统形式的市场保护已减少、受到约束或消除。但是随着贸易的自由化，政府已采用新的不太明显的措施，保护其国内产业免受进口产品的竞争。

技术产品规程、卫生及植物检疫标准、授权机制及不规律的海关估价机制，正是众多公司在走向“全球化”时经常面临的障碍之一。了解这些措施以及评估这些公司是否违反了相关WTO规则均需具备法律方面的洞察力。具备这些知识的同时还需具备商务及政治方面的才干。同时，还需要当地机构及决策者的理解及重视。正是凭借我们的商务及法律洞察力，以及与全球首都决策者的沟通便利，我们可以帮助客户确定有前景的外国市场，制定克服市场障碍的进入策略。

贸易谈判及加入WTO
本行WTO组律师曾就众多政府加入WTO所涉及的各方面事宜提供法律意见。例如，本行曾与欧盟委员会签订合同，就俄罗斯联邦加入WTO提供技术协助。如此前所述，本组的律师和专业人员均曾为全球很多政府（如牙买加和约旦）就WTO义务的遵守提供培训及法律意见。我们的政府客户还聘请我们为其国内贸易法律起草某些章节。

最后，我们的律师拥有丰富的多边及双边贸易谈判经验，这些经验来自他们的日常实践和在政府的工作经历。当前，我们正密切注视多边贸易谈判多哈回合的进展情况。我们还代表政府和企业客户提供分析报告，制定策略并向关键第三方（如：WTO秘书处、各欧盟机构和欧盟成员国、美国贸易代表、美国国会成员、美国财政部、美国商务部和白宫）传达本行客户所关心及关注的事项。
