Experience

We have acted in some of the most significant team move disputes in recent years, across a range of industries for both claimants and defendants. This has included claims litigated in state and federal courts in the US, the courts of justice in Hong Kong and in the High Court and Court of Appeal in England and Wales.

For example, in 2023, we acted for the claimants in the biggest team move case in the London market in decades, resulting in a confidential settlement on the morning of trial. The public elements of the settlement included extensive court undertakings given in favor of our clients to protect their business and a public apology by our clients’ competitor for its admitted unlawful conduct.

Salebuild in Nexsales v. Salebuild – Obtained dismissal with leave to amend and a subsequent voluntary dismissal with prejudice in this trade secret misappropriation and employee-poaching action brought by a competitor.
Mortgage company – Representing in an action enforcing non-solicitation of employees restrictive covenant and alleging claims for misappropriation of confidential information and breach of duty of loyalty in connection with a raid of employees by former employees and a competitor at one of the employer’s locations.
Global interdealer brokers – in Hong Kong we acted on one of the largest poaching cases when more than 35 interdealer brokers and support staff moved en masse from their employer to another. We advised on mitigating the risks associated with the move. The employer who lost the employees applied for a springboard injunction which we successfully defended.
Data communications and telecommunications equipment provider and one of its executives – Representing in two lawsuits involving restrictive covenant, tortious interference, discrimination, and retaliation claims. After obtaining dismissal of nearly all claims against clients, the case settled on favorable terms.
